Congress v. The courts

Unfortunately, Terri Schiavo will shortly die. My prayers are with her and her family. I'm sure all of us, in our hearts, would have preferred a different outcome.

However, personal and moral issues aside, what are the legal issues? On his blog, CREDITWRENCH CEO Bill Bauer states:

United States Congress has the power to ....... tell the U.S.
Supreme Court how it must rule

The Schiavo case proves otherwise. While Congress establishes the law, the courts have final say in all matters of law; that is dicated by the US Constitution.

Again, my heart and prayers go out to Terri and her family.

CREDITWRENCH and the law Part XXVI

This past week on his message board, a consumer posted that she had documented the following violations from a collection agency on her debt:

43 phonecalls after my verified letter 805(c)
1 additional collection attemt by mail after my letter
1 abuse (foreigner - should go back where I came from)
1 failure to provide validation in a timely manner (35 days)
2 collection attempts on Sunday

What was CREDITWRENCH CEO Bill Bauer's advice?

I would not sue them on all of the violations at once. I'd sue them on each
violation separately. Go for one and get that settled and then go for the next
one for the next year or so. The reason you want to sue them on each one
separately is that you are only likely to get $1,000 per violation.

Apparently CREDITWRENCH CEO Bill Bauer doesn't understand the claim preclusion doctrine. Not surprising though since he doesn't understand much of anything that has to do with the law.

Under claim preclusion, all of the above violations would have to be consolidated in a single suit. If she attempted to file multiple suits, only the first suit would be recognized, and subsequent suits would be barred by the court. Only violations that would occur after a suit was filed could give rise to an additional filing.

Not only did CREDITWRENCH CEO Bill Bauer give false and misleading legal advice, he also gave bad strategic advice. Filing suit on all of the violations at one time means the collection agency would have to formulate a defense for each violation, giving her more leverage for a favorable settlement.

CREDITWRENCH is brain dead

Today, CREDITWRENCH CEO Bill Bauer, in his attempt to further prove how brain dead he truly is, posts in a collection forum a post of how to collect debts. Aside from the fact that this would be as insulting to a debt collector as telling an accountant how to count, here is how he does it.
Blogger.com has a feature that allows you to upload a phone conversation to its server here.

CREDITWRENCH CEO Bill Bauer proceeds to call into a standard streaming audio phone conference, and upload the call to the blogger.com server, rather than posting the link to the conference call.
This wastes a huge amount of bandwidth because now someone has to upload a file that could have been streamed, plus, who's going to ever trust a link that CREDITWRENCH CEO Bill Bauer ever posts.
Then he offers to email a file of 46megs. Yeah right. What email server in history would ever accept a file that size.

CREDITWRENCH CEO Bill Bauer offering to email a readily available streaming audio file of 46 megs is, well, further proof he is brain dead.

CREDITWRENCH commits libel

Today in a post on the internet, CREDITWRENCH CEO Bill Bauer commented on William R. Bartmann, former head of defunct debt buyer Commercial Financial Services. In his comments he states:


he is out of jail and doing seminars

Although Bartmann was charged, he was aquitted of all charges.

CREDITWRENCH stating that he was convicted and served jail time is false, misleading, and libelous.

I will be communicating this information to Mr. Bartmann in case he cares to pursue this intentional defamation of his character by CREDITWRENCH CEO Bill Bauer.

CREDITWRENCH, the FDCPA, and tax collection

As a new tactic to enroll "students" CREDITWRENCH CEO Bill Bauer states on a message board:
........allowing collection agencies to collect back taxes for the IRS
opens up a whole new can of worms. These collection agencies will be
violating the FDCPA right and left which means you will more than likely not
have to pay anything once you use the CREDITWRENCH method"

The truth is, collection agencies collecting back income taxes for the IRS would not be subject to the FDCPA.

Why? Because income tax obligations do not fit the definition of a debt within the FDCPA. Even the US Supreme court has held that position.

To quote from applicable case law:

The district court reversed...holding that the tax liability at issue was not consumer debt because it was not incurred, but "involuntarily imposed by the government for a public purpose" and resulted "from earning money rather than
consumption." IRS v. Westberry (In re Westberry), No. 3:98-0438 (M.D. Tenn.

CREDITWRENCH and links

Today in a discussion with a credit professional, it was intimated that links posted by CREDITWRENCH CEO Bill Buaer could contain a virus.

Since that is entirely possible, it is suggested that you never click on a link posted by CREDITWRENCH CEO Bill Bauer. Not only will it most likely lead you to false and misleading information, it could possibly contain a virus that could crash your system.

Better to be safe than sorry.

Updates slow in coming

My apologies for being lax in getting updated information posted on the blog. I have been so inundated with emails asking for clarifications on false and misleading information that CREDITWRENCH advertises and posts relative to credit repair, the FDCPA, and the FCRA, that I haven't been able to keep up with both. But, I wanted to be sure and respond to the emails first.

However, I am working on a solution to the problem and will be updating the blog regularly again shortly.

Another issue I had to address, and have fixed, was the e.normis email volume; the server space allocated by the address I've been using was inadequate. To solve this issue, I have signed up for a new email address that has additional capacity. The new email is:

CREDITWRENCH message board

Although the activity on CREDITWRENCH CEO Bill Bauer's message board has dwindled to nothing buy a couple of his own false identities posting, I noticed this morning someone who appeared to be legitimate, asked a fairly easy question.

CREDITWRENCH CEO Bill Bauer, however, has completely ignored the question. This gives you some insight into the type of sevice one would expect if they were to become a CREDITWRENCH student.

Of course if CREDITWRENCH ever did actually answer a legitimate question, I've already proven numerous times the answer would most likely be false and misleading.

My blog continues to dominate google searches on CREDITWRENCH!

CREDITWRENCH resigned to posting jokes

Under the immense pressure that this blog has brought to bear on CREDITWRENCH CEO Bill Bauer, he has resigned himself to nothing but posting old jokes and pictures. Caught yesterday copying and pasting copyrighted material, Uncle Normie emailed the copyright owner. CREDITWRENCH CEO Bill Bauer promplty expunged the stolen material from his blog and replaced it with a joke.

How fitting, considering his credit repair scam is quickly becoming the biggest joke on the internet.

CREDITWRENCH and FCRA Part V

As has been proven numerous times on my blog, and in fact as CREDITWRENCH CEO Bill Bauer himself has admitted in numerous discussions, he knows absolutely nothing about the FCRA.

Without knowledge of the basics of the FCRA, one has no hope of removing inaccurate information on their credit report. Yet CREDITWRENCH advertises he repairs credit ala Bud Hibbs, John Ghila, and others he emulates. It doesn't take a rocket scientist to figure out that that if CREDITWRENCH CEO Bill Bauer admits to knowing nothing about the FCRA, he can do nothing for your hope to remove inaccuracies on your credit report.
So what does he provide? He provides the information he copies and pastes from other websites like the one he did today from here. That's what he offers for the money he charges; information copied and pasted from another website that itself offers false and misleading information.

Do a google search on CREDITWRENCH. See how many active newsgroups worldwide reference this blog for accurate information. Literally hundreds of them.

Ask CREDITWRENCH CEO Bill Bauer if he conforms to the standards of a credit repair organization outlined by Federal Law in the Credit Repair Organizations Act. An answer other than NO, is false and misleading as he himself has stated publicly, and has been proven here many times over.

The only true statement CREDITWRENCH Bill Bauer has ever uttered is "I know absolutely nothing about the FCRA."

An example of poor service from CREDITWRENCH

If you were to become a CREDITWRENCH "student" what kind of service should you expect.

Several weeks ago a poster on his message board placed a request for contact information on the executive officers of Equifax. As of this date, his request has gone unanswered by CREDITWRENCH CEO Bill Bauer.

Seems CREDITWRENCH CEO is too busy making up fictitious emails from people wanting contact information and posting those requests on collection boards in an attempt to prove what great service he provides.

Hopefully that poster has found this blog, and Uncle Normie is more than happy to accomodate his request that CREDITWRENCH CEO Bill Bauer continues to ignore. It's right here.

CREDITWRENCH and plagiarizing

CREDITWRENCH CEO Bill Bauer likes everyone to believe that the methodologies he posts are his own ideas. He also likes to believe that everyone is in awe of his methods.

Truth is, his ideas are plagiarized from other websites. For example, his "mindset of a collector" was plagiarized from its original author, complete with misspelled words, from flyingifr from Art of Credit . Additionally, because he was exposed for his illegal use of copyrighted work, he attempted to intimidate the original author by implying he "flew his airplane" over his house. The man doesn't have a pot to piss in, much less access to use of an airplane.

He continues to use the above mentioned website as having a high regard for his work. Here is an example of that high regard.

Uncle Normie cannot be intimidated by CREDITWRENCH CEO Bill Bauer's idle threats. Nor, his baseless statements of impending lawsuits against me. CREDITWRENCH CEO Bill Bauer is all show and no go. Anything he states to the contrary is, of course, false and misleading.

I am being called at work at home all because of a coupel of old credit card bills that were'nt paid. I was looking on the internet to see what I could do to stop the constant calls and came across the credit wrench web site. It seemed what I needed but then looking some more I found your web site. I am thankful that I found it as I was almost going to look more into credit wrench. Can you tell me....................

CREDITWRENCH shot out of the saddle........again

One of my first posts on this blog dealt with one of the ridiculous and inaccurate "teachings" of CREDITWRENCH CEO Bill Bauer that in 23 states, original creditors are bound by the FDCPA.

Now Bill Bauer has decided to raise that number to 35 states.

Yesterday in a discussion with a credit professional, CREDITWRENCH Bill Bauer claimed that 35 states bind original creditors to the validation provision of the FDCPA. Of course that is totally false and misleading, and as usual, CREDITWRENCH Bill Bauer was unable to provide any substantive proof of his claim.

He was promptly, and rightly corrected by the collection professional. Someone in the very profession he claims to know more about the law than. Quite obviously, and has been pointed out many times on this blog, CREDITWRENCH CEO Bill Bauer knows little about collection law; most of what he states he makes up. That's why he's never able support his position with either statute or case law.

The Truth about CREDITWRENCH breaks through

Today, when you search the term CREDITWRENCH in either google or yahoo, the first page will show the top 10 links. This blog, or links to it, represent 4 of the 10.

The mission statement of this blog includes being a visable entity to those who would choose to check the validity of CREDITWRENCH'S "teachings" before deciding to enlist his credit repair services.

Based on todays rankings in both google and yahoo, that mission has been accomplished.

And, based on the increasing number of emails I receive daily, the momentum will surely grow expotentially.

CREDITWRENCH and false identities

CREDITWRENCH CEO Bill Bauer has been banned from almost every single message board on the internet that deals with the Fair Debt Collection Practices Act. There are numerous reasons for his being banned, but the main two are:
  1. He uses other's sites to promote his credit repair scam
  2. He provides false and misleading information

Sometimes to circumvent these bans, he creates other identities. In doing so, he utilizes the new identity to praise how wonderful he is.

That's not all. Then this fictional character he invents, creates other fictional characters, all pointed to one goal; praising CREDITWRENCH.

A classic example of this is his alter ego he calls KayKay29. I was the first to identify this fictional creation on CI as none other than CREDITWRENCH CEO Bill Bauer. Others then came along and offered addtional proof to support my suspicions.

However, prior to KayKay29 being exposed as CREDITWRENCH CEO Bill Bauer, KayKay29 creates a boyfriend for herself; an attorney.

KayKay29 then goes on to claim her attorney boyfriend came up against a CREDITWRENCH student, and the student, on his own, won a $100,000 lawsuit.

Of course, since it turns out KayKay29 was actually CREDITWRENCH CEO Bill Bauer, that blew the cover off the made up $100,000 lawsuit won by a CREDITWRENCH student.

Tomorrow, I'll expose another made up character claiming to be a "winning" student.

CREDITWRENCH posing as KayKay29 and claiming a CREDITWRENCH student won a $100,000 judgment is false and misleading information.


CREDITWRENCH never supports his claims

CREDITWRENCH CEO Bill Bauer makes a lot of claims, but never seems to be able to support them. For example, in a discussion he makes the statement:

I'm afraid it is a serious violation of FDCPA and several courts have ruled
that 3rd party collectors have exactly 30 days from the date of their receipt of
the debtor's demand for validation (dispute) and not one day more in which the
demand of the debtor must be in his hands. I've been looking high and low for
those court cases



Well the fact is he can't find them because they don't exist. His comment is completely erroneous and he only states it because it looks like it will support his cause. But, as always, he fails to back it up.
